Anti-Spam guidelines

Permission E-Mail Marketing in Switzerland

Since the 1st of April 2007 the new Swiss law about telecommunications and the fair trade law prohibit the sending out of uncalled e-mail advertising without having the recipients agreement. On each sent out e-mail, the recipient must be granted the possibility to unsubscribe from any further e-mail deliveries without any obstacles. The sender must be clearly recognizable and reachable on each sent out e-mail by indicating valid contact information.

To which recipients you are allowed to send e-mail advertising:

  • Recipients who have signed up via a form on your website. E.g. by checking the newsletter checkbox on a web form, on an online survey or on a competition participation.
  • Recipients who have provided you with their agreement via a written form. E.g. by filling out a written competition participation on which a special newsletter permission was given.
  • Recipients who have handed you their business card and their agreement. E.g. by handing out their business card and their explicit permission to receive future information about your company and your products and services.
  • Clients who have bought a product from you during the past year. E.g. by purchasing one of your products or services. Although it is advisably to directly ask for their permission first.

To which recipients you are not allowed to send e-mail advertising:

Any recipient that is not covered by the above listing.
  • Any recipient lists or e-mail addresses you bought, received or rented from a third party.
  • Any e-mail addresses you have collected on the internet or have saved from your personal e-mail messages over the years.
  • Clients with whom you haven't had any business relation and therefore no contact during the past year.
